Installation Terms and Conditions for Nest Hello

The following Terms and Conditions (“Installation Terms”) apply to installation of Nest Hello in the United States when purchased through the online store (the "Store") provided by Nest Labs, Inc. ("Nest"). These Installation Terms are in addition to and supplement the Terms & Conditions of Sale (the “Sales Terms”), and the Sales Terms are incorporated by reference herein.

INSTALLATION OF YOUR NEST HELLO WILL BE PERFORMED BY AN INDEPENDENT PROFESSIONAL INSTALLER (THE “INSTALLER”) CONNECTED TO YOU THROUGH SERVICELIVE, INC. (“SERVICELIVE”), AN INDEPENDENT COMPANY THAT IS NOT AFFILIATED WITH NEST. NEST WILL NOT PERFORM THE INSTALLATION. THE PROFESSIONAL INSTALLER CONNECTED TO YOU THROUGH SERVICELIVE IS NOT AN EMPLOYEE, SUBCONTRACTOR OR AGENT OF NEST. NEST ASSUMES NO LIABILITY FOR THE ACTIONS, INACTIONS OR ANY WRONGDOING OF SERVICELIVE OR THE INSTALLER.

  1. Scheduling and Cancellation. After you complete the purchase of Nest Hello with professional installation on the Store, you will be offered the option to “schedule now” or “schedule later.” If you chose to “schedule now,” you will be asked to select three time slots for installation in order of preference. If you chose to “schedule later,” Nest will send you an email reminder at a later date with a link to let you book your appointment. Depending on your location, installation appointments are generally available to book from five days after the estimated shipping date provided to you during checkout. Installation appointments may be scheduled to take place only during normal business hours Monday to Friday, subject to the availability of an Installer.

    You will receive an email after booking your appointment to confirm the date and time of your installation. If you want to rebook your installation date or time after confirmation, or cancel your installation, you must call ServiceLive at 888-848-7261. If you cancel your appointment within 24 hours of the scheduled appointment time, you will be charged a $49 cancellation fee.

  2. Your Responsibilities. You must ensure that you have all necessary permissions and consents before installation of Nest Hello, including but not limited to the permission of a landlord or property owner, as applicable. ServiceLive and the Installer reserve the right to review and confirm all necessary permissions and consents before carrying out any installation. Neither Nest, ServiceLive nor the Installer will be liable for your failure to obtain any necessary permission or consent.

  3. Requirements. The Nest Hello is designed to replace an existing wired doorbell. Before beginning installation, your Installer will check that your existing doorbell is compatible and will confirm what work is required to install the Nest Hello in your home. If the Nest Hello is incompatible or cannot be installed, contact Nest Support e for return information.

  4. What’s included in the Installation services:

    • Installation of Nest Hello, the Nest chime connector, and if required, a replacement transformer.
    • Connection of your Nest Hello to your home Wi-Fi service, or, if requested, a demonstration of how you can connect it yourself.
    • A post-installation doorbell test to check that the Nest Hello is correctly installed. The Installer will test that:
      • The Nest Hello has sufficient power (and is not displaying a yellow or red light ring);
      • The chime rings correctly; and
      • You receive Nest app notifications when the doorbell button is pressed.
    • An introduction to the Nest Hello and the Nest app, and a demonstration of how they work.
  5. What’s not included in the installation services: Installation does not include any service that is not explicitly referred to in Section 4 of these Installation Terms. For example, installation does not include the installation of new wires required to power the video doorbell, or replacement of a non-wired doorbell. REVIEW THE SERVICE ORDER PROVIDED TO YOU BY THE INSTALLER, AND CONFIRM AND AGREE TO ANY ADDITIONAL SERVICES REQUIRED OR ANY ADDITIONAL COSTS OR FEES, BEFORE THE INSTALLER BEGINS WORK.

    Nest Hello is likely to be installed in the location of your existing doorbell, but installation does not include redecoration, restoration or repair.

  6. Limitations: Nothing in these Installation Terms and in particular within this section shall attempt to exclude or limit liability that cannot be excluded under applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL (A) NEST BE LIABLE FOR ANY DAMAGES, INCLUDING ANY PROPERTY DAMAGE, ARISING FROM OR RELATING TO THE INSTALLATION SERVICES; (B) NEST BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING ANY PROPERTY DAMAGE OR DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THE INSTALLATION SERVICES, EVEN IF NEST KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES; AND (C) NEST’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE INSTALLATION SERVICES, WHETHER IN CONTRACT OR TORT OR OTHERWISE, EXCEED THE FEES ACTUALLY PAID BY YOU TO NEST FOR INSTALLATION SERVICES. THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM. NEST DISCLAIMS ALL LIABILITY OF ANY KIND OF NEST’S LICENSORS AND SUPPLIERS.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an act or event beyond our reasonable control, including without limitation acts of God, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, terrorist attack, war, fire, explosion, storm, flood, earthquake, epidemic or other natural disaster, failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

These Installation Terms are in addition to any terms and conditions provided to you by ServiceLive and/or the Installer.

These Installation Terms are governed by the laws of the State of California without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. You agree to submit to the personal jurisdiction of the state and federal courts in or for Santa Clara County, California for the purpose of litigating all such claims or disputes.
